Terms of Service

1. Acceptance of Terms
By creating an account or using SquareBerry ("the Service"), operated by Square Berry LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Square Berry LLC. You represent that you have the legal capacity to enter into this agreement.
2. Description of Service
SquareBerry is a land intelligence and feasibility analysis platform that helps real estate developers and investors research parcels, analyze zoning, evaluate development feasibility, and generate reports. The Service includes interactive maps, parcel searches, automated scouts, and comprehensive analysis reports.
We reserve the right to modify, update, or discontinue any feature of the Service at any time. We will provide reasonable notice of material changes that affect your subscription.
3. Eligibility
You must be at least 18 years old to use SquareBerry. By using the Service, you represent and warrant that you meet this age requirement and that you have the authority to agree to these Terms on behalf of yourself or the entity you represent.
4. Accounts and Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at canyonharris@squareberry.app if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.
5. Subscription Plans and Payment
SquareBerry offers the following subscription plans:

All plans receive the same comprehensive analysis report covering property basics, ownership, tax data, zoning details, flood zone status, comp estimates, development considerations, pro forma projections, and risk assessment. Plans differ by the number of reports you can generate per month.
Billing
Paid plans are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions auto-renew at the end of each billing cycle.
Cancellation and Refunds
You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer refunds for partial billing periods.
Price Changes
We reserve the right to change pricing with at least 30 days' notice. Price changes will apply at the start of your next billing cycle after the notice period. If you do not agree to a price change, you may cancel before it takes effect.
6. Usage Limits
Each subscription plan includes specific usage limits as outlined in Section 5 above. These limits include, but are not limited to:
- Number of parcel searches per month
- Number of analysis reports per month (or lifetime for the Free plan)
- Number of active scouts and their search frequency
- Maximum parcels per scout search
If you exceed your plan's limits, certain features may be restricted until the next billing cycle or until you upgrade your plan. We will provide clear notice when you approach or reach your limits.
Usage limits are subject to change. Any changes to limits for existing subscribers will be communicated at least 30 days in advance.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service, its systems, or other users' accounts
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service
- Resell, sublicense, or redistribute access to the Service without our written consent
- Use automated tools, bots, or scripts to extract data from the Service beyond normal use
- Circumvent or attempt to circumvent usage limits, authentication, or security measures
- Interfere with or disrupt the integrity, performance, or availability of the Service
- Upload malicious code, viruses, or any material intended to compromise the security of the platform
- Impersonate another person or entity, or misrepresent your affiliation
- Use the Service to harass, abuse, or harm others
Violation of these terms may result in immediate suspension or termination of your account without prior notice.
8. Intellectual Property
The SquareBerry platform, including its design, code, features, branding, logos, and documentation, is the exclusive property of Square Berry LLC and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose during your subscription term.
You retain ownership of any data you input into the Service. By using SquareBerry, you grant us a limited, non-exclusive license to process your data solely to provide and improve the Service. We will not use your data for purposes unrelated to delivering the Service without your consent.
9. Third-Party Data and Services
SquareBerry integrates data from third-party sources including parcel databases, mapping providers (Mapbox), property records, and public data repositories. This data is provided "as is" and we do not guarantee its accuracy, completeness, timeliness, or suitability for any purpose.
You are solely responsible for independently verifying any information obtained through the Service before making business, investment, or development decisions. SquareBerry is a research tool, not a substitute for professional due diligence.
Third-party services (Stripe, Supabase, Vercel, Mapbox) are governed by their own terms of service and privacy policies. We are not responsible for the practices or availability of third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA.
SquareBerry is a research and analysis tool. It does not provide legal, financial, tax, engineering, environmental, or real estate advice. Feasibility analyses, reports, parcel data, and other outputs are estimates based on available data and algorithms. They should not be relied upon as the sole basis for investment, development, or purchasing decisions.
We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times. We are not responsible for any losses arising from reliance on information provided through the Service.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SQUARE BERRY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Square Berry LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees and costs) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your negligence or willful misconduct.
13. Termination
We may suspend or terminate your access to the Service at any time for cause, including but not limited to: violation of these Terms, non-payment, fraudulent activity, or abuse of the platform. We will make reasonable efforts to notify you before or promptly after termination, unless prohibited by law or where immediate action is necessary to protect the Service.
You may terminate your account at any time by contacting us at canyonharris@squareberry.app or through your account settings.
Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days following termination to allow recovery, after which it will be permanently deleted unless otherwise required by law (see our Privacy Policy for data retention details).
The following sections survive termination: Intellectual Property (8), Disclaimers (10), Limitation of Liability (11), Indemnification (12), Governing Law (16), and any accrued payment obligations.
14. Dispute Resolution
Before initiating any formal legal action, you agree to first contact us at canyonharris@squareberry.app and attempt to resolve the dispute informally for at least 30 days. Many issues can be resolved quickly through direct communication.
If we cannot resolve the dispute informally, both parties agree that any legal proceedings shall be conducted in the courts described in Section 16 (Governing Law).
15. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our practices, features, pricing, or legal requirements. If we make material changes, we will notify you by email or through a prominent notice on the platform at least 30 days before the changes take effect.
Your continued use of SquareBerry after the effective date constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the Service and may cancel your subscription.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Livingston County, Michigan, and you consent to the personal jurisdiction of such courts.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Square Berry LLC regarding the Service and supersede all prior agreements, understandings, or representations.
